1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Hey Creed LLC, a Texas limited liability company ("Hey Creed," "Company," "we," "our," or "us"), regarding your access to and use of the Coach Creed mobile application and related services (collectively, "the Service").

By accessing or using Coach Creed, you agree to be bound by these Terms. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Coach Creed is an AI-powered fitness coaching application that provides:

Personalized workout recommendations
Form analysis and feedback
Progress tracking and analytics
Recovery and readiness assessments
AI coaching interactions

IMPORTANT: Coach Creed is not a substitute for professional medical advice, diagnosis, or treatment.

Always consult a physician before starting any exercise program
Stop exercising immediately if you experience pain, dizziness, or discomfort
The AI recommendations are informational and should not replace professional guidance
You assume full responsibility for your physical activities and any injuries that may occur

4. User Accounts

To use certain features, you must create an account. You agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access
Be responsible for all activities under your account

5. Subscriptions and Payments

5.1 Subscription Tiers

Coach Creed offers a free tier and paid tiers (e.g., Pro). The free tier includes three full workouts per week, reset each Monday. Pro unlocks unlimited workouts, form analysis, intensity tracking, and all specialist coaches. Feature availability, limits, and pricing may vary by tier.

5.2 Pricing and Tier Changes

Hey Creed LLC reserves the right to modify subscription prices, tier structures, feature availability, and free tier limits at any time. Changes may apply to new subscriptions and, where permitted by law, to renewals. We will provide notice of material changes where reasonably practicable (e.g., in-app notice, email, or updated Terms). Continued use of the Service after changes constitutes acceptance.

5.3 Free Tier

The free tier currently includes three qualifying workouts per week (resetting each Monday). Free tier features are offered at our discretion. We may change free tier limits, features, or availability at any time. "Free forever" means we do not charge for the free tier; it does not guarantee that specific features or limits will remain unchanged.

5.4 Paid Subscriptions

Some features require a paid subscription
Subscriptions automatically renew unless cancelled
Refunds are handled according to App Store policies

5.5 Coach Creed Guarantee

Hey Creed LLC may offer a limited-time guarantee ("Coach Creed Guarantee") that permits monthly subscribers to request a refund under certain conditions (e.g., 20 workouts in 60 days). Eligibility is limited to first-time monthly Pro subscribers only. Annual subscribers are not eligible for refunds under this guarantee. Each user may request a refund under this guarantee one time only, and the request must be made within the specified time and workout thresholds. Refunds for in-app purchases are processed by the applicable platform (Apple App Store or Google Play) and are subject to their respective refund policies and procedures. Hey Creed LLC does not directly process refund payments for in-app purchases. Resubscribers and users who have previously received a refund under this guarantee are not eligible. Hey Creed LLC reserves the right to modify, limit, or discontinue this guarantee at any time without prior notice. The guarantee, when in effect, is applied at our sole discretion.

6. User Conduct

You agree not to:

Use the Service for any illegal purpose
Attempt to reverse engineer or hack the Service
Share your account with others
Upload harmful or inappropriate content
Interfere with the proper functioning of the Service

7. Intellectual Property

Coach Creed™ and all content, features, and functionality are owned by Hey Creed LLC and protected by copyright, trademark, and other intellectual property laws. Certain technologies and methods are Patent Pending. Trademark Pending. You may not copy, modify, or distribute such content without prior written permission from Hey Creed LLC.

8. User Content and AI Training

8.1 Content Ownership

You retain ownership of content you create, including workout data, videos, and mobility assessments.

8.2 License Grant

By submitting content to Coach Creed, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to:

Use, store, and process your content to provide the Service
Analyze your form and track your progression over time
Create anonymized, de-identified derivatives for AI model training
Use anonymized data to improve our services and develop new features

This license continues even after you stop using the Service, but only for anonymized data that has already been incorporated into our training datasets. Your original, identifiable content will be deleted upon account termination.

8.3 What This Means

When you record a squat video for form analysis, we may:

Provide immediate feedback on your form
Store the video to show you your progression over weeks/months
Extract anonymized movement patterns to improve our AI for all users

We will never sell your videos or share identifiable footage with third parties.

9. Limitation of Liability

To the maximum extent permitted by law, Hey Creed LLC and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, lost profits, or data loss.

10. Indemnification

You agree to indemnify, defend, and hold harmless Hey Creed LLC, its officers, directors, employees, agents, and affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.

11. Termination

Hey Creed LLC may terminate or suspend your account at any time for violations of these Terms. You may cancel your account at any time through the app settings.

12. Changes to Terms

Hey Creed LLC reserves the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of the State of Texas. Hey Creed LLC is a limited liability company organized under the laws of the State of Texas.
