1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Hey Creed LLC, a Texas limited liability company ("Hey Creed," "Company," "we," "our," or "us"), regarding your access to and use of the Coach Creed mobile application and related services (collectively, "the Service").

By accessing or using Coach Creed, you agree to be bound by these Terms. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Coach Creed is an AI-powered fitness coaching application that provides:

• Personalized workout recommendations
• Form analysis and feedback
• Progress tracking and analytics
• Recovery and readiness assessments
• AI coaching interactions

3. Health Disclaimer

IMPORTANT: Coach Creed is not a substitute for professional medical advice, diagnosis, or treatment.

• Always consult a physician before starting any exercise program
• Stop exercising immediately if you experience pain, dizziness, or discomfort
• The AI recommendations are informational and should not replace professional guidance
• You assume full responsibility for your physical activities and any injuries that may occur

4. User Accounts

To use certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

5. Suscripciones y Pagos

5.1 Niveles de Suscripción

Coach Creed ofrece un nivel gratuito y niveles de pago (p. ej., Pro). El nivel gratuito incluye tres entrenamientos completos por semana, que se reinician cada lunes. Pro desbloquea entrenamientos ilimitados, análisis de forma, seguimiento de intensidad y todos los coaches especialistas. La disponibilidad de funciones, los límites y los precios pueden variar según el nivel.

5.2 Cambios de Precios y Niveles

Hey Creed LLC se reserva el derecho de modificar los precios de suscripción, las estructuras de niveles, la disponibilidad de funciones y los límites del nivel gratuito en cualquier momento. Los cambios pueden aplicarse a nuevas suscripciones y, cuando la ley lo permita, a renovaciones. Proporcionaremos aviso de cambios materiales cuando sea razonablemente posible (p. ej., aviso en la app, correo electrónico o Términos actualizados). El uso continuado del Servicio después de los cambios constituye aceptación.

5.3 Nivel Gratuito

El nivel gratuito actualmente incluye tres entrenamientos calificados por semana (que se reinician cada lunes). Las funciones del nivel gratuito se ofrecen a nuestra discreción. Podemos cambiar los límites del nivel gratuito, las funciones o la disponibilidad en cualquier momento. "Gratis para siempre" significa que no cobramos por el nivel gratuito; no garantiza que las funciones o límites específicos permanezcan sin cambios.

5.4 Suscripciones de Pago

• Algunas funciones requieren una suscripción de pago
• Las suscripciones se renuevan automáticamente a menos que se cancelen
• Los reembolsos se manejan según las políticas de App Store

5.5 Garantía Coach Creed

Hey Creed LLC puede ofrecer una garantía de tiempo limitado ("Garantía Coach Creed") que permite a los suscriptores solicitar un reembolso completo bajo ciertas condiciones (p. ej., 20 entrenamientos en 60 días). La elegibilidad se limita únicamente a suscriptores Pro por primera vez. Cada usuario puede solicitar un reembolso bajo esta garantía solo una vez, y la solicitud debe hacerse dentro del período y umbrales de entrenamientos especificados. Los resuscriptores y usuarios que ya hayan recibido un reembolso bajo esta garantía no son elegibles. Hey Creed LLC se reserva el derecho de modificar, limitar o discontinuar esta garantía en cualquier momento sin aviso previo. La garantía, cuando esté en vigor, se aplica a nuestra exclusiva discreción.

6. User Conduct

You agree not to:

• Use the Service for any illegal purpose
• Attempt to reverse engineer or hack the Service
• Share your account with others
• Upload harmful or inappropriate content
• Interfere with the proper functioning of the Service

7. Propiedad Intelectual

Coach Creed™ y todo el contenido, las funciones y la funcionalidad son propiedad de Hey Creed LLC y están protegidos por las leyes de derechos de autor, marcas registradas y otra propiedad intelectual. 8. User Content and AI Training

8.1 Content Ownership

You retain ownership of content you create, including workout data, videos, and mobility assessments.

8.2 License Grant

By submitting content to Coach Creed, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to:

• Use, store, and process your content to provide the Service
• Analyze your form and track your progression over time
• Create anonymized, de-identified derivatives for AI model training
• Use anonymized data to improve our services and develop new features

This license continues even after you stop using the Service, but only for anonymized data that has already been incorporated into our training datasets. Your original, identifiable content will be deleted upon account termination.

8.3 What This Means

When you record a squat video for form analysis, we may:

• Provide immediate feedback on your form
• Store the video to show you your progression over weeks/months
• Extract anonymized movement patterns to improve our AI for all users

We will never sell your videos or share identifiable footage with third parties.

9. Limitation of Liability

To the maximum extent permitted by law, Hey Creed LLC and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, lost profits, or data loss.

10. Indemnification

You agree to indemnify, defend, and hold harmless Hey Creed LLC, its officers, directors, employees, agents, and affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.

11. Termination

Hey Creed LLC may terminate or suspend your account at any time for violations of these Terms. You may cancel your account at any time through the app settings.

12. Changes to Terms

Hey Creed LLC reserves the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of the State of Texas. Hey Creed LLC is a limited liability company organized under the laws of the State of Texas.
