1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Hey Creed LLC, a Texas limited liability company ("Hey Creed," "Company," "we," "our," or "us"), regarding your access to and use of the Coach Creed mobile application and related services (collectively, "the Service").

By accessing or using Coach Creed, you agree to be bound by these Terms. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Coach Creed is an AI-powered fitness coaching application that provides:

  • Personalized workout recommendations
  • Form analysis and feedback
  • Progress tracking and analytics
  • Recovery and readiness assessments
  • AI coaching interactions

IMPORTANT: Coach Creed is not a substitute for professional medical advice, diagnosis, or treatment.

  • Always consult a physician before starting any exercise program
  • Stop exercising immediately if you experience pain, dizziness, or discomfort
  • The AI recommendations are informational and should not replace professional guidance
  • You assume full responsibility for your physical activities and any injuries that may occur

4. User Accounts

To use certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

5. Abonnements et Paiements

5.1 Niveaux d'abonnement

Coach Creed propose un niveau gratuit et des niveaux payants (ex. Pro). Le niveau gratuit comprend trois entraînements complets par semaine, réinitialisés chaque lundi. Pro débloque des entraînements illimités, l'analyse de la forme, le suivi de l'intensité et tous les coaches spécialistes. La disponibilité des fonctionnalités, les limites et les prix peuvent varier selon le niveau.

5.2 Changements de prix et de niveaux

Hey Creed LLC se réserve le droit de modifier les prix d'abonnement, les structures de niveaux, la disponibilité des fonctionnalités et les limites du niveau gratuit à tout moment. Les changements peuvent s'appliquer aux nouveaux abonnements et, lorsque la loi le permet, aux renouvellements. Nous fournirons un avis des changements importants lorsque raisonnablement possible (ex. avis dans l'app, e-mail ou Conditions mises à jour). L'utilisation continue du Service après les changements constitue une acceptation.

5.3 Niveau gratuit

Le niveau gratuit comprend actuellement trois entraînements éligibles par semaine (réinitialisés chaque lundi). Les fonctionnalités du niveau gratuit sont offertes à notre discrétion. Nous pouvons modifier les limites du niveau gratuit, les fonctionnalités ou la disponibilité à tout moment. « Gratuit pour toujours » signifie que nous ne facturons pas le niveau gratuit ; cela ne garantit pas que des fonctionnalités ou limites spécifiques resteront inchangées.

5.4 Abonnements payants

  • Certaines fonctionnalités nécessitent un abonnement payant
  • Les abonnements se renouvellent automatiquement sauf annulation
  • Les remboursements sont gérés selon les politiques de l'App Store

5.5 Garantie Coach Creed

Hey Creed LLC peut proposer une garantie à durée limitée (« Garantie Coach Creed ») permettant aux abonnés de demander un remboursement intégral sous certaines conditions (ex. 20 entraînements en 60 jours). L'éligibilité est limitée aux abonnés Pro pour la première fois uniquement. Chaque utilisateur ne peut demander un remboursement sous cette garantie qu'une seule fois, et la demande doit être faite dans le délai et les seuils d'entraînements spécifiés. Les réabonnés et les utilisateurs ayant déjà reçu un remboursement sous cette garantie ne sont pas éligibles. Hey Creed LLC se réserve le droit de modifier, limiter ou interrompre cette garantie à tout moment sans préavis. La garantie, lorsqu'elle est en vigueur, est appliquée à notre seule discrétion.

6. User Conduct

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to reverse engineer or hack the Service
  • Share your account with others
  • Upload harmful or inappropriate content
  • Interfere with the proper functioning of the Service

7. Propriété Intellectuelle

8. User Content and AI Training

8.1 Content Ownership

You retain ownership of content you create, including workout data, videos, and mobility assessments.

8.2 License Grant

By submitting content to Coach Creed, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to:

  • Use, store, and process your content to provide the Service
  • Analyze your form and track your progression over time
  • Create anonymized, de-identified derivatives for AI model training
  • Use anonymized data to improve our services and develop new features

This license continues even after you stop using the Service, but only for anonymized data that has already been incorporated into our training datasets. Your original, identifiable content will be deleted upon account termination.

8.3 What This Means

When you record a squat video for form analysis, we may:

  • Provide immediate feedback on your form
  • Store the video to show you your progression over weeks/months
  • Extract anonymized movement patterns to improve our AI for all users

We will never sell your videos or share identifiable footage with third parties.

9. Limitation of Liability

To the maximum extent permitted by law, Hey Creed LLC and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, lost profits, or data loss.

10. Indemnification

You agree to indemnify, defend, and hold harmless Hey Creed LLC, its officers, directors, employees, agents, and affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.

11. Termination

Hey Creed LLC may terminate or suspend your account at any time for violations of these Terms. You may cancel your account at any time through the app settings.

12. Changes to Terms

Hey Creed LLC reserves the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of the State of Texas. Hey Creed LLC is a limited liability company organized under the laws of the State of Texas.
