This Liability Waiver and Release ("Waiver") constitutes a legally binding agreement between you ("User," "you," or "your") and Hey Creed LLC, a Texas limited liability company ("Hey Creed," "Company," "we," "our," or "us"), regarding your use of the Coach Creed mobile application and related services (collectively, "the Service").

1. Acknowledgment of Risks

I understand and acknowledge that participating in physical exercise and fitness activities involves inherent risks, including but not limited to:

• Muscle strains, sprains, and tears
• Bone fractures and joint injuries
• Cardiovascular events including heart attack
• Dizziness, fainting, or loss of consciousness
• Aggravation of pre-existing conditions
• Injuries from improper form or technique
• Injuries from equipment use or malfunction
• Other unforeseen injuries or medical conditions

2. Voluntary Assumption of Risk

I voluntarily choose to participate in physical exercise activities using Coach Creed. I assume full responsibility for any risks, injuries, or damages, known or unknown, which I might incur as a result of participating in these activities.

3. AI-Generated Recommendations

I understand that Coach Creed provides AI-generated workout recommendations, form analysis, and coaching feedback. I acknowledge that:

• AI recommendations are generated by algorithms and may not account for my specific health conditions
• AI form analysis is not a substitute for in-person coaching or medical evaluation
• The AI may provide incorrect, incomplete, or inappropriate recommendations
• I am solely responsible for evaluating whether any recommendation is appropriate for me
• I should consult with healthcare professionals before following any exercise program

4. Medical Clearance

I represent and warrant that:

• I have consulted with a physician and have been cleared for physical exercise, OR
• I accept full responsibility for exercising without medical clearance
• I will immediately stop exercising and seek medical attention if I experience pain, dizziness, shortness of breath, or any unusual symptoms
• I will inform my physician of any new exercise program I undertake

5. Release of Liability

To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue Hey Creed LLC, its officers, directors, employees, agents, affiliates, successors, and assigns (collectively, "Released Parties") from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in any physical activity recommended or facilitated by Coach Creed.

6. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from any loss, liability, damage, cost, or expense (including attorney's fees) that they may incur arising from or related to:

• My use of Coach Creed
• My participation in any physical activities
• Any breach of this Liability Waiver
• Any violation of any law or the rights of any third party

7. No Warranty

The Service is provided by Hey Creed LLC "as is" and "as available" without any warranties of any kind, either express or implied. The Released Parties do not warrant that:

• The AI recommendations will be accurate, complete, or appropriate for your needs
• The form analysis will detect all errors or prevent injury
• The service will be uninterrupted, timely, secure, or error-free
• Any results from using the service will meet your expectations

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Released Parties be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, personal injury, or death, resulting from:

• Your use of or inability to use Coach Creed
• Any recommendations, form analysis, or coaching provided by the AI
• Any physical activities you perform
• Any unauthorized access to or use of our servers and/or personal information

9. Severability

If any provision of this Liability Waiver is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

10. Governing Law

This Liability Waiver shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising from this Waiver shall be resolved in the courts of the State of Texas.

Hey Creed LLC is a limited liability company organized under the laws of the State of Texas.

11. Entire Agreement

This Liability Waiver, together with the Terms of Service and Privacy Policy, constitutes the entire agreement between you and Hey Creed LLC regarding your use of Coach Creed and supersedes all prior agreements and understandings.
